Essential risk and no advice notice

Investing in the stock market, stocks, ETFs, funds or other financial instruments involves a real risk of loss. You may lose some or all of the money invested. No report, analysis, case study, comment, Q&A, company on the radar or other Market Radar content guarantees returns, accuracy, protection of capital or any future outcome.

Whenever Market Radar discusses companies on the radar, opportunities, levels, scenarios, hypotheses or ideas to monitor, these must always be understood as educational content and general analysis. They are not recommendations to buy, sell or hold, or instructions to trade.

Market Radar does not provide personalized financial advice, execute orders, manage portfolios, hold assets in custody, raise funds or administer users' money. Every decision to buy, sell, hold, trade, invest, divest or take no action belongs exclusively to the user, exercising their own judgment and assuming their own responsibility and risk.

For legal, privacy, support, purchasing, withdrawal, refund or user rights inquiries, the primary written contact is hola@albertbretxa.com.

Accessing, browsing, registering for, purchasing or using Market Radar makes you a user and implies acceptance of this legal notice, these terms and conditions, the privacy policy, the cookie policy and the risk notice. If you disagree with this document, you must refrain from using the website, membership and content.

Accessing the website does not, in itself, establish a commercial, professional, financial advisory, wealth management or investment intermediary relationship. A commercial relationship will exist only when the user purchases a membership, product or service offered by Market Radar.

2. Purpose of the service

Market Radar offers a digital membership focused on learning about, monitoring and analyzing markets. Depending on the offering available at any given time, membership may include periodic access to market conditions, companies on the radar, potential opportunities for analysis, market reports or commentary, case studies, Q&A sessions, answers to members' questions, digital materials, newsletters, private posts and other related resources.

Content is delivered digitally and may be updated, reorganized, expanded, removed or replaced. Unless a specific offer expressly establishes a fixed frequency, the timing, format, schedule, methodology, access or availability of certain content may vary for technical, editorial, commercial, security or service improvement reasons.

Important membership does not include individualized financial advice, account management, trade execution, real time alerts, mandatory personalized signals, promises of returns or personalized assistance unless expressly stated in a specific offer.

3. Users, minimum age and accounts

To use the membership or access paid content, you must be over 18 and have sufficient legal capacity to enter into a contract. The user declares that the information they provide during registration, purchasing, payment, billing or support is accurate, current and lawful.

If the service requires an account, the user is responsible for keeping their credentials confidential, preventing unauthorized access and reporting any misuse or suspected breach to hola@albertbretxa.com. Market Radar may suspend, restrict or cancel accounts when it detects fraudulent use, unauthorized account sharing, breach of these terms or risks to the security of the service.

4. Purchasing, payments, cancellation and withdrawal

Plans, pricing and renewal

The contract for Market Radar is entered into between the user and Gap Pattern LLC. Unless the purchasing page states otherwise, a monthly membership is offered at 59 euros per month and an annual membership at 590 euros per year. Displayed amounts are final prices and include any applicable taxes. Before payment is confirmed, checkout will display the selected plan, total amount, billing frequency and renewal terms.

Membership renews automatically at the selected frequency, every month for the monthly plan and every twelve months for the annual plan, until the user cancels it. Payments are processed through Stripe and may be technically managed through WordPress, Paid Memberships Pro or equivalent tools. Market Radar does not store full card details.

Price changes will not affect periods already paid for. If a change will apply to a future renewal, it will be communicated in advance through a reasonable channel so that the user can learn the new price and cancel before renewal if they do not wish to continue.

Canceling renewal

The user can cancel renewal from their member area, when this option is available, or request help by writing to hola@albertbretxa.com. Cancellation must take place before the next renewal date to avoid a new charge.

Ordinary cancellation prevents future charges, but does not constitute exercising the right of withdrawal and does not, by itself, entitle the user to a refund for the current period. Unless there is a valid withdrawal, an improper charge, a lack of conformity or another applicable legal right, the user will retain access until the end of the monthly or annual period already paid for, and no full or proportional refund of that period will be issued.

Right of withdrawal and 14 day refund guarantee

When the user enters into a distance contract as a consumer and the statutory right of withdrawal applies, they may exercise it during the fourteen calendar days following the date the contract is concluded, without stating a reason and without penalty, in accordance with current legislation.

In addition, as a contractual guarantee favorable to the user and without prejudice to their statutory rights, Market Radar will refund the full amount of the first monthly or annual purchase if the withdrawal notice is sent within that period. This guarantee remains in place even if digital access was activated immediately or the user viewed content during those fourteen days.

The contractual fourteen day guarantee applies to the initial membership purchase and does not automatically restart with each renewal, a plan change or later account reactivation. This clarification does not restrict any right of withdrawal, termination, refund or guarantee that is mandatory under the law in a particular case.

How to exercise the right of withdrawal

You do not need to use a web form to withdraw. Simply send an email, before the period ends, to hola@albertbretxa.com containing an unequivocal statement of your decision to withdraw. To help locate and process the purchase promptly, please include the account holder's name, the account email, the plan purchased, the purchase date and, if available, the order or payment identifier. Missing any of these details will not invalidate an unequivocal notice sent within the period if the purchase can be identified by other means.

Market Radar will confirm receipt of the request by email. Compliance with the deadline will be assessed using the date on which the user sent their notice.

Effects and timing of the refund

Once the right of withdrawal has been validly exercised, membership will end and Market Radar may deactivate the account or prevent further access to digital content and services. From that point, the user must stop using the content and may not copy it, retain it for unauthorized uses or make it available to third parties.

Gap Pattern LLC will refund the payments received for the purchase being withdrawn from without undue delay and, in any event, within fourteen calendar days of being informed of the decision. The refund will use the same payment method as the purchase unless the user expressly agrees to another method that incurs no costs for them.

Other refund circumstances

Outside the above period, the user may report any duplicate or incorrect charge, a charge made after a cancellation processed on time, inability to access the service attributable to the service or a lack of conformity by writing to hola@albertbretxa.com. Each case will be reviewed in accordance with applicable legislation and the established circumstances. This policy does not restrict the consumer's statutory rights regarding digital content or services that do not conform to what was contracted.

Cancellation, withdrawal or a refund does not imply the immediate deletion of data that must be retained for legally required periods for tax, accounting, security, fraud prevention or defense against claims.

Sample withdrawal notice

The following sample is optional. The user may copy it into an email or use any other unequivocal statement.
